Why register a federal trademark?
Using a name in commerce creates some common law rights. Federal USPTO registration provides substantially more.
Nationwide Legal Protections
Federal registration provides important nationwide protections and a legal presumption of your exclusive right to use the mark in connection with the registered goods or services.
Public Notice
Your mark is recorded in the USPTO database, placing others on constructive notice of your claim and helping deter adoption of similar marks.
Filing Date on Record
Your USPTO application records a filing date. This can be relevant in disputes with others who subsequently seek to register a similar mark, though trademark rights also depend on actual use in commerce.
Use of the Registered Trademark Symbol
Only federally registered trademark owners may use the registered trademark symbol, signaling federal registration to competitors and customers.
U.S. Customs Recordation
Registered marks can be recorded with U.S. Customs and Border Protection to help block importation of infringing goods.
Basis for International Filing
A U.S. federal registration can serve as the basis for trademark applications in other countries under the Madrid Protocol.
How the process works

We discuss your brand, business, filing strategy, and likely trademark classes. No commitment required.

Application Filing
We prepare your application — selecting the correct class, drafting the description of goods/services, and filing with the USPTO.
USPTO Examination
The USPTO reviews the application, typically reaching first examination in roughly 4-5 months. We monitor the application and keep you informed.

Frequently asked questions
What does the $1,499 flat fee include?
The fee covers: a comprehensive clearance search with written attorney analysis; attorney consultation on strategy, class selection, and description of goods/services; preparation and filing of the USPTO application; correspondence with the USPTO on routine matters; and support through registration for use-based applications.
What are USPTO filing fees?
USPTO filing fees are government fees paid directly to the U.S. Patent and Trademark Office. They are separate from our attorney fee and currently start at $350 per class of goods or services filed through the USPTO Trademark Center.
What happens if I receive an Office Action?
Routine correspondence is included. Substantive Office Action responses — where the USPTO has raised a legal issue requiring a written argument — are separately scoped and priced based on the complexity of the refusal.
How long does trademark registration take?
The USPTO typically reaches initial examination in roughly 4–5 months from filing. Many straightforward use-based applications complete in approximately 8–12 months total, though this varies depending on USPTO workload, whether an Office Action is issued, and whether the mark is intent-to-use.
Do I need to be in a specific state to use Vallo Law?
No. Federal trademark registration is handled before the USPTO, a federal agency. Vallo Law represents clients nationwide in USPTO trademark matters.
What is the difference between a trademark and a business name?
A business name (or DBA) is registered with a state or local government for business formation purposes. A trademark protects how you identify your goods or services in the marketplace. They are separate legal concepts: registering a business name does not give you trademark rights, and a trademark registration does not replace a business name filing.
