Frequently Asked Questions

What does a trademark clearance search include?

Our clearance search covers the USPTO federal trademark database (live and dead applications and registrations), common law sources, state trademark registrations, domain names, and similar-sounding or similar-looking marks. You receive a written attorney opinion summarizing what we found and our assessment of registrability.

How long does the search take?

We typically deliver your written search opinion within 5–7 business days of receiving your order.

What happens after the search?

We provide you with a written opinion summarizing what we found and our assessment of registrability. If you decide to proceed, we apply the $999 search fee toward the cost of a full trademark registration ($1,499 attorney fee).

Do I need a clearance search before filing?

A clearance search is not legally required, but it is strongly recommended. Filing without a search creates real risk: the USPTO may refuse your application based on a prior mark you did not know existed, and you could receive a cease-and-desist from a business already using a similar name.

What if the search finds a conflict?

We will explain what we found, what it means for your filing prospects, and what options you have — including whether it makes sense to modify your mark, file in different classes, or consider alternative branding.
